These terms apply to 9horsemen.com, the Gallop builder, the websites Gallop creates and the Gallop Admin app (the "services"), all run by 9horsemen Limited, a New Zealand company ("we", "us"). By using the services, you agree to them.
Using Gallop for your business
The services are designed and offered for business use only. You must be at least 18 and authorised to agree to these terms for the business you represent.
- Business use: because you're acquiring the services in trade, for business purposes, you agree that the Consumer Guarantees Act 1993 doesn't apply, and that sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 don't apply between you and us. We both agree this is fair and reasonable.
- If you're a consumer: if the law treats you as a consumer, nothing in these terms limits any rights you have under the Consumer Guarantees Act or other consumer laws that can't be excluded.
Your account
You're responsible for your account and for what happens under it, including anything done by team members you invite. Keep your sign-in details secure and tell us straight away if you think someone else has used them.
- Inactive Free accounts: to keep the platform secure, if an account on the Free plan has no sign-ins and no published site activity for 12 months in a row, we may permanently delete the account and its data. We'll email the address on file at least 30 days before we do.
- Ending accounts without cause: we may suspend or close any account, for any reason, by giving you 30 days' written notice. If we do this without cause, we'll refund the unused part of any fees you've prepaid for the current billing period.
Plans, billing and chargebacks
- The Free plan costs nothing. Paid plans and add-ons are billed in advance, in US dollars, through our payment provider, Stripe.
- Paid plans and add-ons renew automatically each billing period until you cancel.
- If a plan comes with a free trial, you'll be charged when the trial ends unless you cancel before then.
- You can cancel at any time in Plan & add-ons. Cancelling takes effect at the end of the current billing period, and you keep paid features until then.
- We don't refund partial billing periods, except where the law requires it.
- Prices don't include taxes. Where tax such as GST applies, it's added to your bill.
- We'll give you at least 30 days' notice before a price change applies to you.
- If a payment fails and isn't fixed, we may move your account to the Free plan. Features that aren't on the Free plan then stop working, but your content isn't deleted.
- Payment disputes: please contact us before disputing a charge with your bank. Filing a chargeback or payment dispute without contacting us first is a material breach of these terms, and we may suspend your account and take your sites offline straight away.
Your content
You own the content you add, such as your business details, photos and customer records. You give us permission to host, copy, process and display it as needed to run, secure and support the services. You're responsible for having the right to use anything you upload.
- AI-generated output: we claim no ownership of what Gallop generates from your prompts. As long as you follow these terms, we assign to you any rights we have in the site designs and content generated for you.
- Card and banking details: you must not use Gallop forms, fields or records to collect, store or send card numbers, security codes (CVV) or banking passwords.
- Feedback: if you send us comments, ideas or feature requests about Gallop, we're free to use them without any obligation or payment to you.
- Publicity: you allow us to use your business name, logo and screenshots of your Gallop site in our marketing, worldwide and free of charge. You can withdraw this at any time by emailing hello@9horsemen.com with the subject "Publicity opt-out".
Our platform
We own the services, including the Gallop builder, the business app, the site templates and the software behind them. While your account is active, you may use them to run your site. Gallop is a hosted service: it doesn't give you source code to download, copy or host elsewhere. You can export your content and customer records at any time, or ask us to export them for you.
AI-generated content
Gallop uses AI to draft your site. AI output is probabilistic: it can contain errors or state things that aren't true, and it may look like content made for other people, so we can't promise it's unique.
- Your responsibility: you must check and approve everything Gallop generates, including text, claims, designs, prices and hours, before you publish it. You're responsible for making sure your site complies with advertising, consumer protection, fair trading and accessibility laws and standards (such as WCAG).
- Our AI providers' rules: Gallop runs on AI models from providers including Anthropic and Google, and you must follow their acceptable use policies. Trying to get the AI to produce prohibited content (such as illegal material, malware, hate speech or content designed to deceive), or doing anything that causes a provider to suspend or investigate our account, is a material breach of these terms.
- No AI tampering: you must not try to jailbreak, prompt-inject, reverse-engineer or extract the system prompts behind Gallop.
- Beta features: features marked "beta", "preview" or "early access" are experimental. They're provided "as is", without service levels or warranties, and may change, break or be withdrawn at any time without notice.
Stock photos
Gallop can suggest photos from Unsplash. They're used under the Unsplash License, and the photographer credit shown on your site must stay in place. If a photo is removed from Unsplash, it disappears from your site too.
The Gallop credit
Your site shows a small "Built with Gallop by 9horsemen" link in its footer, and emails we send to your customers on your behalf say they were sent with Gallop. The credit links to Gallop and helps other businesses find us. It's part of the service and stays in place on every plan, and you must not hide or remove it.
Infrastructure and third-party providers
Gallop runs on independent providers for hosting, databases, messaging, billing, product analytics and AI, including Cloudflare, Supabase, Resend, Stripe, PostHog, Anthropic and Google. Some features rely on others, such as Google Search Console for the Get found on Google add-on. Connecting a third-party service means you also agree to that service's terms.
- No control over providers: these providers operate independently of us. We don't control their availability, security, server locations, data handling or business practices.
- Provider failures: to the extent the law allows, we're not liable for data loss or corruption, security incidents, unauthorised access, API changes, rate limits or downtime caused by these providers.
- Backups: you're responsible for keeping your own copies of business data, customer records and site assets that matter to you. You can export them at any time.
Acceptable use
Don't use the services to:
- break the law, or offer goods or services that are illegal where you or your customers are;
- mislead or harm people, including phishing, collecting passwords or payment details, or pretending to be another person or business;
- collect other people's information without permission;
- send spam, or messages people haven't agreed to receive;
- infringe anyone's copyright, trade marks or other rights;
- spread malware, or interfere with the services or other users.
How we keep the services safe
To protect the services, our customers and the public, we may inspect, scan and analyse sites, content, messages and account activity, both automatically and by hand. We do this to detect fraud, abuse and breaches of these terms, and to meet legal obligations. If we find a problem, we may remove content, take a site offline, or suspend or close an account. We'll usually tell you first, but we may act straight away if there's a risk of harm.
Reporting a problem
If a site on Gallop is harmful, a scam or infringes your rights, email hello@9horsemen.com with the site's address and what's wrong. We may pass your report on to the site's owner.
For copyright complaints, including notices under the US Digital Millennium Copyright Act (DMCA), include:
- a description of the work you own;
- the address of the page where it appears;
- your contact details;
- a statement that you believe in good faith the use isn't authorised;
- a statement, under penalty of perjury, that you own the copyright or are authorised to act for the owner.
We close the accounts of repeat infringers in appropriate circumstances.
Messages to your customers
Gallop sends emails to your customers for you, such as sign-in codes, booking confirmations, reminders and receipts. They come from Gallop's sending domain under your business's name. They're for transactional messages only, not marketing. We may limit or pause sending from a site to protect our sending reputation.
You promise that you have your customers' contact details lawfully and any consent the law requires, including under the Unsolicited Electronic Messages Act 2007 and anti-spam laws elsewhere. You'll cover us for any fines or penalties caused by messages sent for you.
Your customers and their information
If you take bookings or record sales through Gallop, you're responsible for your relationship with your customers, including your prices, refunds and any taxes. Gallop records payments you take. It is not a payment processor.
You control your customers' personal information and you're responsible for having your own privacy policy for them. We hold and process it for you, as your processor (your agent under the Privacy Act 2020), only to provide the services and as described in our privacy policy. Our Data Processing Addendum forms part of these terms and sets out our obligations as your processor under privacy laws such as the GDPR.
If we confirm a security incident affecting your customers' records, we'll tell you without undue delay, and within 72 hours of confirming it, and give you reasonable information to help you meet your own notification duties, at your expense.
Addresses, domains and previews
- Previews: previews that aren't claimed are deleted automatically.
- 9horsemen.com addresses: a 9horsemen.com address is a revocable licence to use that address, not property, and can't be transferred. We may reclaim, change, suspend or revoke it at any time if it's misleading, risks phishing or our reputation, infringes someone's rights or belongs to a closed account.
- Your own domain: if you connect your own domain, you're responsible for registering it, renewing it and keeping its settings correct. We may disconnect a domain that is used to break these terms.
Sanctions
You promise that you aren't located in, controlled by, or a national or resident of a country under a comprehensive United States or New Zealand embargo, and that you aren't on any restricted-party list. You must not use the services to deal with sanctioned people or organisations.
Changes and availability
We're always improving the services, which means features may change. We work hard to keep everything running, but we can't promise the services will always be available or free of errors.
Ending your account
You can stop using the services at any time and ask us to delete your account. We may suspend or close accounts that break these terms or leave bills unpaid. Export anything you want to keep first. After an account closes, we delete its data as described in our privacy policy, except records the law requires us to keep.
Liability
The services are provided "as is" and "as available". To the extent the law allows:
- 9horsemen Limited and its suppliers aren't liable for indirect, consequential, incidental, special or punitive losses, such as lost profits, lost revenue, lost data or business interruption;
- our total liability for all claims about these terms or the services is limited to the greater of what you paid us in the 12 months before the claim and US$100.
Nothing in these terms limits liability for fraud, death or personal injury, or any other liability that can't legally be limited.
Indemnity
You agree to cover 9horsemen Limited, its directors and affiliates for any claims, losses, fines or legal costs arising from:
- your content;
- your dealings with your customers;
- publishing AI-generated content you didn't check;
- your breach of a third-party provider's terms, such as those of Anthropic, Google, Supabase or Stripe;
- your breach of these terms.
General
- Events outside our control: we're not liable for delays or failures caused by things outside our reasonable control, such as natural disasters, internet or telecommunications outages, or outages at our cloud or AI providers.
- Severability: if any part of these terms can't be enforced, the rest still applies.
- No waiver: if we don't enforce a term straight away, we can still enforce it later.
- Assignment: you can't transfer your account or your rights under these terms to anyone else without our written agreement, except to someone who buys your business. If you do that, email us first so we can move the account to the new owner, who must agree to these terms. We may transfer these terms to another business as part of a merger, sale of assets or restructure, and we'll let you know if we do.
- Entire agreement: these terms, together with our privacy policy, our Data Processing Addendum and any plan or add-on details shown when you subscribe, are the whole agreement between you and us about the services. They replace any earlier agreements or understandings about the same subject.
Governing law
These terms are governed by New Zealand law, and the courts of New Zealand have exclusive jurisdiction over any dispute about them. To the extent the law allows, disputes will be resolved individually, and you waive any right to bring or take part in a class or representative action against 9horsemen Limited.
Changes to these terms
If we change these terms, we'll update the date at the top of this page and, for significant changes, let account holders know before they take effect.
